What if the custodial parent wants to move away from the non-custodial parent?

In Florida, if a parent with the majority of the parenting time wants to move a distance of 50 miles or greater from their current residence, they need to comply with the obligations under the Relocation Statute. Those require notice to the other parent of the intention or desire to move. That notice needs to be in writing. That gives the other parent the opportunity to agree to the relocation or to object to the relocation.

If the other parent objects to the relocation, the parent with the majority of the parenting time needs to file a petition for relocation and comply with the requirements under the law. In which case I would recommend that any parent with the majority of the parenting time that wishes to relocate consult with an attorney to make sure that you comply with the strict requirements of the statute.
